陳?告贏中選會 未來「反對票公投」有望成案
前行政院長陳冲於去年提起「負數票公投」提案，但遭中選會以未完成補正程序而駁回此公投案，此公投案因而無法成案。陳冲不服，提起行政訴訟，4日台北高等行政法院判決陳冲勝訴，可以繼續辦理此公投案，全案仍可上訴。
陳冲於107年3月8日提起「負數票公投」提案，內容為「人民可以投下反對票，希望改變選舉制度，不再是只能投票、投廢票或不投票。」
但中選會以四點理由要求陳冲補正，憲法規定我國選舉為相對多數制，負數票選舉制度有違憲可能；另外，提案內容中提到的「淨贊成票」為負值的真意為何，有需要釐清；理由書中提到「聯合國秘書長推選方式」與「負數票投票制」的敘述與事實不符；公投法規定主文及理由書須以「文字」為之，但該理由書中，含有圖案，應予補正。但陳冲補正後，仍遭中選會以補正不符為理由駁回其提案。
法院認為，只要選舉方式合乎選舉權、平等權，縱使是本件負數票，也不能認為違反自由民主憲政制度，且公投法是保障人民的創制及複決權，有疑義時，行政機關應該做出對人民有利的解釋，而不是限制人民在公投事項的行使。法院指出，憲法解釋是大法官的職權，行政機關無權認定違憲，如果該創制案通過，行政院研擬後，送交立法院審議，是否違憲是在立法後，由大法官解釋認定。
判決指出，關於圖案的部分，雖然法條規定使用文字，且有字數限制，但圖示往往比較易懂，如果將圖示換成文字來計算，不超過規定的兩千字，應無違反公投法規定，縱使超過，只要不將圖示刊登於公報即可，不能作為駁回的理由。
在其他補正事項部分，因該公投案只是立法原則的創制，如何制訂法規，是由立法院來裁量，若以立法細節質疑該公投案，作為駁回理由，並不恰當。
因此，法院認為，陳冲要求繼續辦理該公投案合理，中選會駁回的處分有不合法規之處，因此撤銷中選會的駁回處分，判決中選會應以公投法繼續辦理此公投案的審查程序，但全案仍可上訴。
